Terms and Conditions

Introduction
Welcome to Tekhelp (Pvt) Ltd. (DBA Build My Online Store).
Tekhelp (Pvt) Ltd. (“Tekhelp”, “Build My Online Store”, “us”, “we”, or “our”) operates Build My Online Store (hereinafter referred to as the “Service”).
By accessing or using our website and services, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, please refrain from using our Service.
Definitions
“Company”, “We”, “Us”, or “Our” refers to Tekhelp (Pvt) Ltd. (DBA Build My Online Store), a company registered in Sri Lanka under company registration number PV00307724.
“Client”, “You”, or “Your” refers to the individual or business using our Service.
“Service” refers to e-commerce consulting, development, and technical support services provided under the Build My Online Store brand.
“Agreement” refers to these Terms and Conditions, which govern the relationship between the Client and the Company.
Scope of Service
Build My Online Store provides professional e-commerce consulting, development, and ongoing support services to individuals, startups, and small to medium-sized businesses worldwide.
Our Service includes, but is not limited to, store setup, theme customisation, UI/UX adjustments, performance optimisation, app integrations, automation setup, and strategic consultation.
All work is performed remotely via secure communication channels. The scope, turnaround time, and deliverables may vary based on the project proposal, support plan, or service package selected.
On-site assistance is not included unless explicitly agreed in writing.
Client Responsibilities
To ensure smooth collaboration and timely delivery, you agree to:
- Provide accurate and complete information related to your project or request
- Share necessary credentials or platform access (e.g., Shopify) when required
- Review deliverables and provide feedback or approvals within a reasonable timeframe
- Ensure that all content, images, and materials you provide comply with intellectual property laws
- Use our services in a lawful and professional manner
Prohibited Use
You may not use our Service to:
- Violate any local, national, or international law or regulation
- Attempt to gain unauthorised access to other systems or networks
- Engage in activities that may damage, disable, or disrupt our Service or reputation
- Misrepresent or resell our Service without written consent
Payment Terms
For store development projects, a 50% advance payment is required before work begins, with the remaining 50% payable upon completion and before the website or final deliverables are handed over.
For maintenance, support, or subscription-based services, the full payment must be made upfront, in advance of the billing cycle or plan term.
Invoices or payment links are issued via email or WhatsApp and processed through secure payment gateways.
All prices are quoted in USD, exclusive of any applicable taxes, transaction, or currency conversion fees.
Note: Clients are responsible for any third-party or platform-related costs, such as Shopify subscription fees, app charges, domain renewals, hosting, or email marketing tools. Build My Online Store only charges for development, configuration, consulting, and related professional services and does not collect payments on behalf of external providers.
Refunds, if applicable, are subject to our Refund Policy, and unused hours or tickets in a support plan do not roll over unless explicitly stated in your agreement.
Intellectual Property
Upon full and final payment, all deliverables, including custom code, design assets, content structures, configurations, and other materials specifically created for the client, become the exclusive property of the client.
However, any tools, templates, frameworks, snippets, libraries, or proprietary components developed by Tekhelp (Pvt) Ltd. (DBA Build My Online Store) that are not uniquely tailored to the client and do not contain the client’s branding, data, or proprietary information shall remain the intellectual property of Tekhelp (Pvt) Ltd. and may be reused in future projects.
We may use visuals, insights, or performance learnings from completed projects for portfolio, case study, or internal improvement purposes, unless the client requests otherwise in writing.
Confidentiality
We treat all client communications, data, and credentials as strictly confidential.
No sensitive information will be shared with third parties except as necessary to deliver the agreed services or when required by law.
Subcontractors working under our direction are bound by the same confidentiality standards.
Limitation of Liability
Our services are provided on an “as-is” basis. While we aim for high-quality results, Build My Online Store does not guarantee specific sales outcomes, traffic levels, or conversion improvements.
We are not liable for:
- Data loss, downtime, or loss of revenue resulting from the use or misuse of our Service
- Errors or disruptions caused by third-party platforms, apps, or hosting providers
- Client delays, inaccurate information, or failure to follow recommended instructions
Our total liability in any case shall not exceed the total amount paid by the client for the specific service in question.
Third-Party Tools & Services
We may recommend or configure third-party tools such as Shopify apps, marketing platforms, hosting services, or analytics tools as part of the project.
However, we are not responsible for:
- Pricing, subscription renewals, or policy changes by third-party providers
- Service outages, data breaches, or performance issues of those external platforms
- Future compatibility or version changes outside our control
The client is solely responsible for maintaining active subscriptions and complying with the third-party provider’s terms.
Service Modifications & Termination
Build My Online Store reserves the right to modify, suspend, or discontinue any part of the Service at any time.
Clients may terminate ongoing services or subscriptions with at least 14 days’ written notice, unless otherwise stated in the agreement.
All outstanding invoices must be cleared before final deliverables, credentials, or files are handed over.
We may terminate services for non-payment, misuse, or violation of these Terms.
Governing Law & Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of Sri Lanka.
Both parties agree to make reasonable efforts to resolve any disputes amicably through direct communication.
If resolution cannot be reached:
- Either party may terminate the agreement.
- The client shall compensate Tekhelp (Pvt) Ltd. (DBA Build My Online Store) for all completed work up to the termination date.
- Reasonable termination costs may be invoiced where applicable.
